The Committee of Chief Prosecutors sends to the Tribunal a Motion on the Abuse of Rights Granted to the Defence

“The Defendants and their defence counsels use to the detriment of the trial the rights of the accused under the Charter and make numerous requests to call witnesses who can testify nothing on the merits of the case, and calling of witnesses will only delay the trial unnecessarily.

The Defendant Sauckel, for example, moved to summon 55 witnesses, including Hildenbrandt, who could testify about Sauckel's authority for recruitment and allocation of foreign workers, although there was ample undisputed evidence on this point before the Tribunal.

The Defendant Jodl filed a motion to summon his wife as a witness, who could "confirm" that he had objected to Goebbels' use of extreme measures against the Jews, etc.

The Prosecution therefore respectfully submits a motion to the Tribunal to reconsider the decision to call the defence witnesses”.

The International Military Tribunal granted the request of the Committee of Chief Prosecutors.
